Custodial Interrogation Not Needed as Investigation Complete: Chhattisgarh HC

The Chhattisgarh High Court has granted bail to an individual accused in a fake GST ITC case worth Rs 11.44 crore, observing that custodial interrogation is not needed as the investigation is complete.

The court noted that the accused has cooperated with the investigation and there is no likelihood of the accused tampering with the evidence or fleeing from justice.

The order comes in a case where the accused was alleged to have claimed fake Input Tax Credit (ITC) under the Goods and Services Tax (GST) regime.

The GST authorities had alleged that the accused had claimed ITC on the basis of fake invoices, resulting in a loss of Rs 11.44 crore to the exchequer.

The accused had moved the high court seeking bail, arguing that the investigation was complete and there was no need for custodial interrogation.

The high court, while granting bail, observed that the accused has cooperated with the investigation and there is no likelihood of the accused tampering with the evidence or fleeing from justice.

The court also noted that the accused is a resident of Chhattisgarh and has roots in the society, and therefore, there is no likelihood of the accused fleeing from justice.
